## How do we move an existing worker onto an EOR?

Worker status depends on the substance of the relationship, including control, equipment and whether the person operates a business on their own account. A contract label is not sufficient by itself.

Applies to: Hong Kong employee/self-employed distinction; no determination of a specific worker’s historic status.

Still to establish: Actual working relationship, historic liabilities, new employer route and written terms

- Determine historic employee/contractor classification and potential arrears.
- Establish whether the proposed EOR employment/agency route is lawful for this role.
- Confirm new terms, any recognised service, immigration and payroll enrolment.
- Actual working relationship, historic liabilities, new employer route and written terms

## How do we manage employment after onboarding?

The Labour Department states that an employer must inform an employee intelligibly of changes to the relevant employment conditions.

Applies to: Hong Kong Employment Ordinance employment-condition disclosure; disclosure alone does not establish that a detrimental change is lawful.

Still to establish: Consent, written record, unreasonable variation protections and actual proposed change

- Confirm the specific change or payroll event and applicable statutory/collective rules.
- Identify who can approve and sign, required notice/consent, and employee remedies.
- Validate payroll timing, accrued entitlements and employer documentation for the worker.
- Consent, written record, unreasonable variation protections and actual proposed change
