## What does employment cost above salary?

## Does TUPE apply when we switch a Great Britain EOR?

Applies to: Great Britain TUPE; territorial and transfer conditions require assessment

It may, but an EOR switch is not automatically a TUPE transfer. Have the old and new employers assess the actual arrangement before asking employees to resign or accept replacement terms.

Supported rule: Acas explains that TUPE can apply to business transfers and service-provider changes where the legal conditions are met.

## Can a new Great Britain EOR replace transferred terms with its standard contract?

Applies to: Employment protected by TUPE; individual terms and proposed changes need review

If TUPE applies, do not treat the provider’s standard template as authority to change transferred terms. Ask for the lawful basis for each proposed change and the required employee agreement.

Supported rule: Acas identifies restricted circumstances for changing terms after TUPE, including agreed economic, technical or organisational changes involving workforce changes, or agreed changes unrelated to the transfer.
